Hiremco Mobil Uygulama Kullanım Şartları

1. Kabul ve Yürürlük
Bu Kullanım Şartları ("Şartlar"), ENZO BİLİŞİM ELEKTRONİK SANAYİ VE TİCARET LİMİTED ŞİRKETİ ("Hiremco", "Şirket") tarafından geliştirilen ve Google Play üzerinden dağıtılan mobil uygulamaların ("Uygulama") kullanımını düzenler. Uygulamayı indirip kullanarak bu Şartları kabul etmiş sayılırsınız. Kabul etmiyorsanız Uygulamayı kullanmayınız.
2. Kapsam
Bu Şartlar, Hiremco'nun geliştirip Google Play üzerinden yayınladığı ve bu sayfaya bağlantı veren tüm mevcut ve gelecekteki mobil uygulamalar ("Uygulama") için geçerlidir. Şartlar tek bir ortak sayfadır; yeni bir uygulama eklendiğinde bu sayfanın ayrıca güncellenmesi gerekmez, ilgili uygulamanın Meta/Google Play ayarlarından bu sayfaya bağlantı verilmesi yeterlidir.
3. Kullanıcı Yaşı
Uygulama 13 yaş altı kullanıcılar için tasarlanmamıştır. 18 yaşından küçükseniz, Uygulamayı ebeveyn veya yasal vasinizin gözetiminde ve onayıyla kullanmalısınız. Ebeveyn denetimi amacıyla sunulan uygulamalarımız, ebeveynler veya yasal vasiler tarafından kurulup yönetilmek üzere tasarlanmıştır.
4. Kullanım Kuralları
Uygulamayı kullanırken aşağıdakileri yapmamayı kabul edersiniz:
- Yürürlükteki kanunlara aykırı şekilde kullanmak,
- Uygulamayı tersine mühendislik yapmak, kaynak koduna erişmeye çalışmak veya kopyalamak,
- Uygulamanın güvenlik önlemlerini aşmaya veya devre dışı bırakmaya çalışmak,
- Başka bir kullanıcının hesabını veya cihazını izinsiz kullanmak,
- Uygulama üzerinden üçüncü kişilerin fikri mülkiyet haklarını ihlal eden içerik yüklemek veya paylaşmak.
RetroX PRO'ya özel — Kullanıcı içeriği ve telif sorumluluğu: RetroX PRO, kullanıcının kendi cihazına yüklediği oyun dosyalarını (ROM) çalıştıran bir emülatör platformudur. Hiremco, bu dosyaları sağlamaz, dağıtmaz ve barındırmaz. Kullanıcı, cihazına yüklediği her dosyanın yasal olarak elde edildiğinden ve telif haklarına uygun kullanıldığından tek başına sorumludur. Hiremco, kullanıcıların yüklediği içerikten doğan telif hakkı iddialarından sorumlu tutulamaz.
5. Uygulama İçi Satın Alma ve Abonelik
Bazı uygulamalarımızda aylık, yıllık veya ömür boyu premium üyelik satın alınabilir. Bu satın almalar Google Play Faturalandırma sistemi üzerinden gerçekleştirilir ve Google Play'in ödeme, iptal ve iade koşullarına tabidir. Abonelikler, iptal edilmediği sürece otomatik olarak yenilenir; iptal işlemi Google Play hesap ayarlarından yapılır. İade talepleri Google Play politikaları çerçevesinde değerlendirilir, Hiremco doğrudan iade yapmaz.
6. Fikri Mülkiyet
Uygulama, tasarımı, yazılımı, logosu ve markası dahil tüm hakları Hiremco'ya aittir. Bu Şartlar, size Uygulamayı yalnızca kişisel ve ticari olmayan amaçlarla kullanmanız için sınırlı, devredilemez bir izin verir; Uygulama üzerinde mülkiyet hakkı doğurmaz.
7. Üçüncü Taraf Hizmetler
Uygulama, işlevlerini yerine getirmek için Google Play Hizmetleri, Google Play Faturalandırma ve Meta (Facebook) reklam/olay ölçümü gibi üçüncü taraf hizmet ve yazılım kütüphanelerini (SDK) kullanabilir. Bu hizmetler kendi kullanım şartlarına ve gizlilik politikalarına tabidir; Hiremco bu üçüncü taraf hizmetlerin kendi işleyişinden sorumlu değildir.
8. Gizlilik
Kişisel verilerinizin nasıl toplandığı ve kullanıldığı hakkında bilgi için Gizlilik Politikamızı inceleyebilirsiniz. Uygulamayı kullanarak bu politikayı kabul etmiş olursunuz.
9. Sorumluluğun Sınırlandırılması
Uygulama "olduğu gibi" sunulmaktadır. Hiremco, Uygulamanın kesintisiz veya hatasız çalışacağını garanti etmez. Yürürlükteki mevzuatın izin verdiği azami ölçüde, Hiremco, Uygulamanın kullanımından doğan dolaylı, arızi veya sonuç niteliğindeki zararlardan sorumlu tutulamaz.
10. Hizmetin Değiştirilmesi ve Sonlandırılması
Hiremco, Uygulamayı önceden bildirimde bulunmaksızın değiştirme, güncelleme veya kullanımdan kaldırma hakkını saklı tutar. Bu Şartları ihlal ettiğiniz tespit edilirse, hesabınıza veya Uygulamaya erişiminiz kısıtlanabilir.
11. Mücbir Sebep
Hiremco; doğal afet, salgın hastalık, savaş, altyapı/internet kesintisi, Google Play veya diğer üçüncü taraf hizmet sağlayıcılardaki kesintiler gibi makul kontrolü dışındaki sebeplerden kaynaklanan gecikme veya hizmet aksaklıklarından sorumlu tutulamaz.
12. Uygulanacak Hukuk ve Uyuşmazlık Çözümü
Uygulama dünya genelinde Google Play üzerinden indirilebilir. Uygulamayı hangi ülkeden indirdiğinize veya kullandığınıza bakılmaksızın, bu Şartlar Türkiye Cumhuriyeti kanunlarına tabidir. Bu Şartlardan doğabilecek uyuşmazlıklarda İstanbul (Anadolu) Mahkemeleri ve İcra Daireleri ile Tüketici Hakem Heyetleri yetkilidir. Bulunduğunuz ülkenin tüketici mevzuatının size tanıdığı vazgeçilmez haklar saklıdır.
13. Bölünebilirlik
Bu Şartların herhangi bir maddesinin yetkili bir mahkeme tarafından geçersiz veya uygulanamaz bulunması, Şartların geri kalan maddelerinin geçerliliğini etkilemez.

15. Değişiklikler
Hiremco, bu Şartları zaman zaman güncelleyebilir. Önemli değişiklikler Uygulama içinden veya web sitemiz üzerinden duyurulur. Güncellemeden sonra Uygulamayı kullanmaya devam etmeniz, yeni Şartları kabul ettiğiniz anlamına gelir.

Hiremco Mobile Application Terms of Use

1. Acceptance and Effect
These Terms of Use ("Terms") govern your use of the mobile applications ("Application") developed by ENZO BİLİŞİM ELEKTRONİK SANAYİ VE TİCARET LİMİTED ŞİRKETİ ("Hiremco", "the Company") and distributed through Google Play. By downloading and using the Application, you accept these Terms. If you do not accept them, do not use the Application.
2. Scope
These Terms apply to all current and future mobile applications developed and published by Hiremco on Google Play that link to this page. This is a single shared Terms page; it does not need to be updated when a new application is added — it is sufficient to link the new application's Meta/Google Play settings to this page.
3. User Age
The Application is not designed for users under the age of 13. If you are under 18, you must use the Application under the supervision and with the consent of a parent or legal guardian. Applications offered for parental-control purposes are designed to be installed and managed by parents or legal guardians.
4. Rules of Use
By using the Application, you agree not to:
- Use it in violation of applicable law,
- Reverse-engineer the Application, attempt to access its source code, or copy it,
- Attempt to bypass or disable the Application's security measures,
- Use another user's account or device without authorization,
- Upload or share content through the Application that infringes the intellectual property rights of third parties.
Specific to RetroX PRO — User content and copyright responsibility: RetroX PRO is an emulator platform that runs game files (ROMs) that users load onto their own devices. Hiremco does not provide, distribute, or host these files. The user is solely responsible for ensuring that every file loaded onto their device was obtained legally and is used in compliance with copyright law. Hiremco cannot be held liable for copyright claims arising from content uploaded by users.
5. In-App Purchases and Subscriptions
Some of our applications offer monthly, annual, or lifetime premium memberships. These purchases are processed through the Google Play Billing system and are subject to Google Play's payment, cancellation, and refund terms. Subscriptions renew automatically unless cancelled; cancellation is done through your Google Play account settings. Refund requests are evaluated under Google Play policies — Hiremco does not process refunds directly.
6. Intellectual Property
All rights to the Application, including its design, software, logo, and brand, belong to Hiremco. These Terms grant you a limited, non-transferable license to use the Application for personal, non-commercial purposes only; they do not create any ownership rights in the Application.
7. Third-Party Services
The Application may use third-party services and software libraries (SDKs) — such as Google Play Services, Google Play Billing, and Meta (Facebook) advertising/event measurement — to perform its functions. These services are subject to their own terms of use and privacy policies; Hiremco is not responsible for the operation of these third-party services.
8. Privacy
For information on how your personal data is collected and used, please review our Privacy Policy. By using the Application, you accept this policy.
9. Limitation of Liability
The Application is provided "as is." Hiremco does not guarantee that the Application will operate uninterrupted or error-free. To the maximum extent permitted by applicable law, Hiremco shall not be liable for indirect, incidental, or consequential damages arising from use of the Application.
10. Modification and Termination of Service
Hiremco reserves the right to modify, update, or discontinue the Application without prior notice. If you are found to have violated these Terms, your access to your account or the Application may be restricted.
11. Force Majeure
Hiremco shall not be liable for delays or service disruptions arising from causes reasonably beyond its control, including natural disasters, epidemics, war, infrastructure/internet outages, or outages at Google Play or other third-party service providers.
12. Governing Law and Dispute Resolution
The Application is available for download worldwide through Google Play. Regardless of the country from which you download or use the Application, these Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of İstanbul (Anadolu) and Consumer Arbitration Committees have jurisdiction over any disputes arising from these Terms. Any mandatory consumer rights granted to you under the law of your own country remain reserved.
13. Severability
If any provision of these Terms is found invalid or unenforceable by a competent court, the remaining provisions shall continue in full force and effect.

15. Changes
Hiremco may update these Terms from time to time. Material changes will be announced within the Application or on our website. Continuing to use the Application after an update constitutes acceptance of the revised Terms.
